Terms of Service

By downloading or using ActivArt ("the app", "the service", "we", "us"), you agree to these Terms of Service. If you do not agree, do not use the app or this website.

1. Description of the Service

ActivArt is a mobile application that reads your fitness activity data from connected sources or FIT activity files you explicitly select, scans photos on your device taken during those activities, and lets you apply AI image effects, generate artistic scenes, animate selected original or generated photos, add custom logos, and render GPS-route and elevation-profile videos. FIT processing, photo scanning, and GPS/elevation video rendering happen locally; requested AI image and AI-video generation uses the processing described below.

2. Third-Party Integrations

To use ActivArt, you may need a valid account with Intervals.icu, Strava, or other health platforms. You agree to comply with their respective terms of service. ActivArt is not responsible for the availability, accuracy, or timeliness of data provided by these third parties.

Requested AI processing may be performed by specialist hosted services or ActivArt-operated processing infrastructure. Those services and their underlying models may be unavailable, delayed, safety-filtered, or changed. ActivArt controls routing and may disable new AI-video jobs for reliability, safety, capacity, or cost reasons without affecting retrieval of an already-completed job during its retention period.

3. AI Processing

AI image effects and text-to-image generation are processed by third-party AI services. To use these features:

• When you apply an AI effect to one of your photos (image-to-image), the selected photo is transmitted securely solely for the duration of that generation and is not retained afterwards.
• When you generate art from your activity type without a source photo (text-to-image), no photo data is sent at all, only a text description of your activity and style preferences.
• Free-tier and Premium usage are subject to rolling allowances (see the in-app paywall for current limits).
• AI image animation accepts one selected original or generated photo. It uploads that image and a description of the selected style, effects, activity controls, and statistics for hosted or private AI processing. The result may include generated audio and is retained privately for a short period so interrupted jobs can resume.
• You are responsible for ensuring your inputs comply with applicable acceptable-use policies.

AI transparency: Images generated from activity data and photos transformed with AI receive machine-readable provenance metadata identifying ActivArt and the type of AI involvement. AI-generated videos receive signed provenance metadata. The app discloses AI involvement while processing and sharing, while ActivArt's website visibly labels published AI examples. Mandatory provenance is separate from the optional ActivArt brand watermark.

4. User Responsibility

You are responsible for ensuring you have the legal rights to any photos you process or share through ActivArt. We do not host or monitor the content you create.

5. User-Generated Content

ActivArt is a creative tool. You are solely and exclusively responsible for any content you create, share, or publish using ActivArt.

By using ActivArt, you agree not to create, generate, share, or attempt to create content that:

• Constitutes child sexual abuse material (CSAM) or sexualises minors in any form;
• Depicts real individuals in a sexual, intimate, or otherwise compromising manner without their explicit consent (including AI-generated "deepfakes");
• Defames, harasses, bullies, intimidates, threatens, or ridicules any individual or group;
• Is hateful, discriminatory, or derogatory on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic;
• Violates the privacy, dignity, or rights of any person;
• Incites violence, terrorism, or self-harm;
• Infringes any third-party intellectual property, trademark, or copyright;
• Is obscene, fraudulent, or otherwise illegal.

You must not intentionally remove, overwrite, or tamper with a machine-readable AI provenance marker applied by ActivArt. If content could falsely appear authentic or truthful, you must clearly disclose its AI origin whenever you publish or share it and provide any additional disclosure required by the law that applies to you.

ActivArt does not pre-screen, monitor, or take responsibility for content generated or shared by users. If you are a third party who believes content created using ActivArt has harmed you, please contact us at [email protected].

6. Suspension and Termination

We reserve the right, at our sole discretion, to suspend, restrict, or permanently terminate your access to ActivArt, without notice and without refund, if we have reasonable grounds to believe that you have used, or attempted to use, the app to create or share content that is illegal or that otherwise violates these Terms.

Where required by law, we may cooperate with law enforcement authorities and report illegal content to the relevant agencies.

7. Premium Features & Purchases

ActivArt is free to download and includes a free tier. Two paid options are available, both managed by the platform app stores:

• ActivArt Premium: a recurring monthly subscription that unlocks larger AI image and AI-video allowances, unlimited stats overlays, unlimited custom logos, unlimited GPS-route and elevation-profile videos, the option to hide the optional ActivArt brand watermark, and automatic processing of new activities. Mandatory AI-origin disclosures remain.
• Custom Logos: a one-time purchase that unlocks unlimited custom logo overlays.

Subscriptions auto-renew until cancelled. You may cancel at any time via your App Store or Google Play Store account.

ActivArt may also issue promotional codes, including through shareable offer links. Anyone with an offer link may attempt to use its code, subject to the offer's eligibility and redemption limits. You can enter a code on the ActivArt redemption page, but you must sign in before the code can be checked or applied to your account. Codes may provide a non-renewing Premium trial, paid-duration Premium access, or lifetime Custom Logos access. Each code may have a redemption window and a limited or unlimited number of uses. Codes have no cash value, cannot be transferred after redemption, do not automatically renew, and do not extend already-paid access unless the offer explicitly says otherwise. ActivArt may disable codes that are expired, exhausted, distributed in error, or used fraudulently.

ActivArt is provided "as is" and "as available". We shall not be liable for any damages resulting from the use of the app, including loss of photos, data, unexpected AI generation results, or content created by users.
